Ate defective candy-need advice?
My wife found a bristle of a brush embedded in a candy she was eating. It scratched the inside of her mouth. I have the remaining piece and the wrapper. I called the company with the complaint, but I haven’t heard from them yet. Any suggestions on how to handle this? I was looking for a law related catagorie but could find anything, so I chose this one. Thanks for any feedback!
Unless, G-d forbid, your wife develops some kind of a gangrene from the bristle scratch despite adequate medical care, I don’t see much of a lawsuit here. To recover in a personal injury lawsuit, you need damages — and with damages such as a scratch in the mouth, it’s really more trouble than it’s worth.
You can write a few nasty letters to Consumer Affairs and to the Health Department where the candy company is located, maybe the FDA — but that’s as far as it will get.
